This expert letter assesses a foreign national’s accomplishments and qualifications and describes how he or she has satisfied the USCIS requirements for classification as an alien of exceptional ability. In addition to establishing that at least three of the evidentiary criteria (the three prongs of Matter of Dhanasar) have been met, this letter demonstrates that the beneficiary has a degree of expertise significantly above that ordinarily encountered in the sciences, engineering, technology, arts or business. Unlike other employment-based visas, the NIW waives the requirement of a job offer and labor certification, provided the petitioner/applicant can demonstrate that their work is in the national interest of the U.S.

It is our understanding that the test for all national interest waiver cases is three-pronged:
1. That the foreign national’s proposed endeavor has both substantial merit and national importance,
2. That he or she is well positioned to advance the proposed endeavor, and
3. That, on balance, it would be beneficial to the United States to waive the job offer and labor certification requirements.
It is also our understanding that an individual needs to hold “Exceptional Ability” in his/her field (an individual in this category must meet at least 3 of the criteria below) and/or have an advanced degree or a bachelor’s degree plus 5 years work experience in the field.

- Letters documenting at least 10 years of full-time experience in your occupation.
- A license to practice your profession or occupation.
- Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability.
- Membership in a professional association(s).
- Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations or other comparable evidence of eligibility is also acceptable.
