To qualify for an EB-1 visa, the petitioner must provide evidence that she or he is a person of extraordinary ability within the sciences, arts, education, business, or athletics and plan an endeavor within an area relevant to that discipline

Eligibility criteria for an EB1-A Visa: 

An EB-1A visa is meant for those with extraordinary abilities. In order to qualify for an EB-1A, you must be able to demonstrate extraordinary ability in the sciences, arts, education, business, or athletics. This is proven in a variety of ways, but each needs to be through a sustained national or international acclaim. To petition for this visa, you need to meet 3 of 10 criteria stated below, or you need to present a one-time achievement. EB-1A extraordinary ability examples for a one-time achievement include receiving an Oscar, a Nobel Prize, an Olympic medal, or an award of equivalent nature.

To demonstrate your status as a person with extraordinary abilities, you need to be able to provide evidence for 3 of the 10 following qualifications if you do not have an internationally recognized award or achievement. These criteria should show a sustained national or international recognition:

  • Lesser recognized award for excellence
  • Proof of your original scientific, scholarly, artistic, athletic, or business-related contributions in your field of expertise
  • Published material about your excellence in either professional or trade publication or other major media
  • Authorship in scholarly, professional, or trade media
  • Commercial success in the performing arts
  • Being asked to judge others individually or on a panel for their work
  • Have had work displayed at artistic exhibitions and/or showcases
  • Membership in a distinguished association or organization whose membership relies on having an extraordinary ability
  • Performing a leading role in a distinguished organization
  • Proof you command a high salary or significant payment in relation to others in your field.

To qualify for an EB1-B visa there are 3 requirements:

  • You must be internationally recognized as being outstanding in an academic field
  • You must have at least 3 years of experience teaching and/or doing research in your academic field
  • You must have a US job offer to work in a teaching position or as a researcher.

Eligibility Requirements for an EB1-C Visa: 

To be qualified for an EB1C visa, the following criteria must be met:

  • The foreign worker must have been employed outside the United States in a managerial or executive capacity for at least one of the three years preceding the application.
  • The foreign worker must have been transferred to the U.S. company to work in a managerial or executive capacity.
  • The U.S. company must have a qualifying relationship with the foreign company, such as being a branch, subsidiary, affiliate, or parent company.
  • The foreign worker must be entering the United States to continue to work in a managerial or executive capacity for the same employer or a related employer.
  • In addition to these eligibility requirements, the foreign worker must also meet the U.S. immigration laws and regulations, including the requirement to have a valid passport and a valid job offer from a U.S. employer.
